Elizabeth McCullough and Dennis Dorsey won summary judgment in a $1.75 million Cumberland County case.  The plaintiff sustained a spiral fracture of her finger, underwent surgery, and when the pins were removed a recommendation for a home exercise program and formal occupational therapy was made by the orthopaedic surgeon.  The plaintiff denied any such recommendation was made and alleged that because OT was not timely ordered, she developed a contracture requiring three more surgeries and a fusion of the finger on her dominant hand.  Plaintiff alleged $1.75 million in lost wages due to her inability to practice as a dental hygienist.  McCullough and Dorsey were successful in striking the Plaintiff’s only causation expert on a Daubert motion.
